Prize 1 - Favorite Place to Drink Beer

Where is your favorite place to drink Beer?

Breckenridge Brewery and Momentile need to know. Grab a Momentile of your favorite place to drink beer and send it to breckbrews@mtile.me. The Breckenridge Brewery judges will select their favorite Momentile and send the winner a case of Breckenridge Beer and a Breckenridge Brewery shirt!

The winner will be selected on September 21, 2009.

Prize 2 – Have a beer with us!

Come have a beer with us on September 21, 2009 between 5pm – 8pm MST at the Breckenridge Brewery – 2220 Blake Street, Denver CO.

While at the event, grab a Momentile and send to breckbrews@mtile.me. The Breckenridge Brewery judges will select the best Momentile from the party and send the winner a $100 Breckenridge Brewery gift certificate, a case of Breckenridge Brewery beer, and a Breckenridge Brewery shirt.

The winner will be selected after the event on September 22, 2009.

OFFICIAL “CELEBRATE BEER WITH US” CONTEST RULES

By entering the Celebrate beer with us! Contest (“Contest”), you (“Contestant”) agree to the following terms and conditions (“Contest Rules”). By providing any entries to the Contest, you signify that you have read, understand, and agree to the Contest Rules. Should you object to any term or condition of the Contest Rules, your only recourse is to not participate in the Contest.

ELIGIBILITY

• Contestants must be at least 21 years of age as of the date of entry.
• Contestants must have an active Momentile user account and valid email address.
• If Prize #1 winner does not reside in the United States or lives is a US County or State that prohibits the shipping of alcohol beverages, a prize of equal value will be provided.
• Prize #2 contestants must be present at the Have a beer with us! event on 10/21/09 at Breckenridge Brewery Blake Street Pub to be eligible.
• Residents of any State or Country where Contest is prohibited by law are ineligible.

HOW TO ENTER

• Contestants much have an active Momentile account.
• Each Prize #1 or Prize #2 entry can be submitted via email by sending the picture (“Picture”) as an email attachment to breckbrews@mtile.me or visit momentile.com/events/breckbrews (“Website”) to upload the entry.
• Each Picture submitted is a separate entry to the contest. Contestants may enter as many Pictures as they choose.

TIME FOR ENTRY

• Prize #1 Contest begins September 4, 2009 and ends September 20, 2009. All Entries must be received by September 20, 2009 at 11:59am MST (GMT -7).
• Prize #2 Content begins September 21, 2009 5pm MST (GMT -7). All Entries must be received by September 21, 2009 8pm MST.

PRIZE WINNERS

• Prize #1 winner will be available online at momentile.com/events/breckbrews on September 20, 2009.
• Prize #2 winner will be available online at momentile.com/events/breckbrews on September 21, 2009.

SPONSORS

The contest is sponsored by Breckenridge Brewery, 471 Kalamath Street, Denver CO 80204 (”Sponsor”).

ENTRY RULES

• Each Picture, in its entirety, must be a single work of original material taken by Contestant.
• By entering the Contest, Contestant represents, acknowledges, agrees, and warrants that the Picture is an original work created solely by Contestant. Contestant further represents and warrants that the Picture does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity, or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the Picture. Any Picture that infringes on any intellectual property rights of others may be disqualified.
• The Picture must not, in the sole and unfettered discretion of Sponsor or Momentile.com, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content. Pictures deemed inappropriate may be disqualified at the sole discretion of Sponsor or Momentile.com.
• Pictures that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud. When photographing the work of others, it must be as an object in its environment and not a full-frame close up of another person’s art.
• If the Picture includes other people, Contestant must have a personal release from all persons who appear in the submitted Picture authorizing use of the Picture.
• All Contestants are further bound by the Momentile.com terms and conditions at momentile.com/terms.

LIMITATION OF LIABILITY

By participating, Contestant agrees to release, discharge, and hold harmless Breckenridge Brewery, Cheddro Wilsons Inc. (Momentile.com service provider), and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents, and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder. IN NO EVENT WILL SPONSOR OR ITS DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, PHYSICAL, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR ANY DAMAGES RESULTING FROM YOUR ENTRY INTO THE CONTEST.

Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. Sponsor is not responsible for any problems with or technical malfunction of any wireless network, computer online systems, servers or providers, computer equipment, software, failure of any e-mail entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, human errors of any kind, or any combination thereof, including any injury or damage to contestant’ or any other persons’ computers related to or resulting from participation, uploading or downloading of any materials related to this Contest.

CONDITIONS

Entries are void if the Sponsor, in its sole discretion, determines the Picture was not created by Contestant or infringes on another’s rights. Entries are void if the Pictures are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

Contestant agrees (a) to be bound by these Contest Rules; (b) that the decisions of the Judges are final on all matters relating to the Contest; and (c) if he/she wins that Sponsor may use Contestant’s name, Picture, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval. All federal, state, and local taxes, fees, and surcharges on prizes are the sole responsibility of the Prizewinner. In the event that the selected winner of any prize is ineligible or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another Contestant.

GOVERNING LAW

By participating in the Contest, Contestant agrees that the laws of the State of Colorado, without regard to principles of conflict of laws, will govern the Contest and any dispute of any sort that might arise between Contestant and Sponsor or any of Sponsor’s affiliates. Contestant agrees not to commence or prosecute any action in connection therewith other than in the state and federal courts of Colorado, and Contestant hereby consents to, and waives all defenses of lack of personal jurisdiction with respect to, venue and jurisdiction in the state and federal courts of Colorado.
